1. Application

These Terms & Conditions apply to all products sold by Concrete Sealing Supplies ("we", "us", "our") and form part of every order placed with us.

By placing an order, collecting products, accepting delivery, making payment, or using our website, you agree to these Terms & Conditions.

2. Orders

Orders may be placed online, by phone, email or in person.

We reserve the right to accept or decline any order at our discretion.

An order is not accepted until:

Payment has been received (where applicable); and
We confirm acceptance of the order.

2.1 Order Acceptance

A contract for supply is formed when:

The customer places an order;
Concrete Sealing Supplies accepts the order; or
Concrete Sealing Supplies procures, orders, supplies or makes available any products relating to the order.

Until a contract is formed, Concrete Sealing Supplies reserves the right to decline any order at its discretion.

2.2 Refusal of Sale

Concrete Sealing Supplies reserves the right to refuse supply of products to any person where:

Products are unavailable;
Payment cannot be verified;
Fraud is suspected;
The customer breaches these Terms & Conditions; or
Supply would be unlawful or unsafe.

3. Quotations

Any quotation provided by Concrete Sealing Supplies:

Is an estimate only;
Is not an offer to supply products;
Is subject to product availability;
May be withdrawn or amended at any time before acceptance; and
Is valid for 30 days unless otherwise stated in writing.

Quotations are based on information available at the time they are issued and may be subject to change where supplier pricing, availability or specifications change.

4. Pricing

All prices displayed are in Australian Dollars (AUD).

Prices include GST unless otherwise stated.

We reserve the right to correct pricing errors, product descriptions, stock quantities and website inaccuracies at any time.

If a pricing error affects an order already placed, we will contact you before proceeding.

4.1 Pricing Errors

While every effort is made to ensure pricing accuracy, Concrete Sealing Supplies reserves the right to correct any pricing, product description, stock availability or website errors at any time.

If an error affects an order that has already been placed, we will contact the customer to discuss available options, including order amendment, substitution, cancellation or refund.

5. Payment

Payment must be received in full before products are released for collection or delivery unless otherwise agreed in writing.

We accept payment methods displayed on our website and in-store.

5.1 Payment Methods

Payment may be made online, in-store, by EFTPOS, bank transfer, cash or any other payment method accepted by Concrete Sealing Supplies from time to time.

Orders may be collected and paid for in-store unless the product has been specially ordered, custom manufactured or otherwise requires payment in advance.

Bank transfer payments must be cleared and received in the Concrete Sealing Supplies bank account before products will be released for collection or delivery. Proof of transfer or remittance advice does not constitute cleared funds.

Concrete Sealing Supplies reserves the right to verify payment before releasing products for collection or delivery.

Where payment is reversed, disputed, charged back or otherwise not received, Concrete Sealing Supplies reserves the right to withhold release of products and cancel the order.

6. Special Order Products

Many products sold by Concrete Sealing Supplies are ordered specifically to fulfil customer orders and may not be held in stock at our premises.

Once an order has been accepted, processed or products have been ordered from a supplier, it cannot be cancelled, amended, exchanged or refunded due to:

Change of mind;
Incorrect product selection;
Surplus materials;
The customer no longer requiring the product; or
Project cancellation or delays.

Nothing in this clause excludes any rights available under Australian Consumer Law.

Products specially ordered, custom tinted, custom manufactured or procured specifically for a customer are not eligible for cancellation, exchange or return except where required under Australian Consumer Law.

6.1 Deposits for Special Orders

Concrete Sealing Supplies may require full payment or a deposit before ordering products from suppliers.

Any deposit paid towards specially ordered, custom tinted, custom manufactured or supplier-procured products may be retained to recover reasonable costs incurred if the customer cancels the order after acceptance.

Where products have been specially ordered, custom manufactured, custom tinted or procured specifically for a customer, full payment may be required before the order is placed with the supplier.

6.2 Supplier-Procured Products

Many products offered for sale are procured from suppliers specifically in response to customer orders and may not be held in stock at our premises.

Customers acknowledge that once Concrete Sealing Supplies has committed to purchasing or procuring products on behalf of a customer, the order cannot be cancelled, exchanged or refunded except where required under Australian Consumer Law.

7. Collection of Products

Customers will be notified when products are available for collection.

Collection is available from:

Customers are encouraged to inspect products at the time of collection.

We may require proof of identity, proof of purchase or order confirmation before releasing products for collection.

Risk and responsibility for products pass to the customer upon collection.

7.1 Uncollected Orders

Customers should collect products within 14 days of being notified that their order is ready for collection.

If products remain uncollected after 30 days and no alternative arrangement has been agreed in writing, Concrete Sealing Supplies reserves the right to:

Charge reasonable storage fees;
Cancel the order;
Return products to stock where possible; and
Retain reasonable costs incurred in procuring or storing the products.

Nothing in this clause affects any rights available under Australian Consumer Law.

Where products have been specially procured, custom manufactured or custom tinted for a customer, Concrete Sealing Supplies may retain any deposit or payment to recover reasonable costs incurred.

8. Delivery

Concrete Sealing Supplies operates primarily as a collection-based business.

Delivery may be available by prior arrangement only and may incur additional charges.

Delivery fees must be agreed and paid before delivery is scheduled.

Delivery charges are non-refundable once delivery has been completed.

Delivery dates and times are estimates only and are provided in good faith. Concrete Sealing Supplies shall not be liable for delays caused by traffic conditions, weather events, supplier delays, freight delays or circumstances beyond our reasonable control.

Customers requiring delivery should contact us before placing an order or prior to collection to discuss availability and obtain a delivery quote.

Concrete Sealing Supplies reserves the right to accept or decline delivery requests at its discretion.

Risk and responsibility for products pass to the customer upon delivery.

Delivery charges quoted by Concrete Sealing Supplies are based on information provided by the customer. Additional charges may apply where delivery conditions differ from those originally disclosed.

8.1 Delivery Access

Where delivery has been arranged, customers must ensure safe and reasonable access for unloading.

If delivery cannot be completed due to access restrictions, unsafe conditions, incorrect delivery details or the absence of a person authorised to receive the goods, additional delivery charges may apply.

8.2 Delivery Providers

Concrete Sealing Supplies may use third-party carriers, couriers or contractors to fulfil deliveries.

The use of third-party delivery providers does not affect any rights available to consumers under Australian Consumer Law.

9. Product Availability

Product availability is subject to supplier stock levels and demand.

If a product becomes unavailable after an order is placed, we may:

Offer an alternative product;
Provide revised lead times; or

If you require a product for a specific purpose, it is your responsibility to ensure the product is suitable for that purpose before purchase.

11. Product Information and Safety

Customers acknowledge that certain products supplied by Concrete Sealing Supplies may contain chemicals, solvents or hazardous substances.

Customers are responsible for ensuring products are handled, stored, transported, applied and disposed of in accordance with:

Manufacturer instructions;
Technical Data Sheets (TDS);
Safety Data Sheets (SDS);
Applicable workplace health and safety requirements; and
Any applicable laws or regulations.

Concrete Sealing Supplies accepts no responsibility for injury, loss, damage or product failure resulting from improper handling, storage, transportation or use of products after collection or delivery.

Concrete Sealing Supplies accepts no responsibility for product deterioration, contamination, reduced shelf life or reduced performance resulting from improper storage, handling or transportation after collection or delivery.

13.1 Colour and Finish Variations

Product colour, gloss level, appearance, texture and final finish may vary depending on:

Surface preparation;
Substrate condition;
Application methods;
Coverage rates;
Weather conditions;
Drying conditions;
Existing surface colour and texture; and
Product batch variations.

Product images, colour charts, samples and website photography are intended as guides only and may not represent the final appearance of the applied product.

Claims should include:

Proof of purchase;
Order details; and
Supporting photographs where applicable.

15. Returns and Refunds

16. Limitation of Liability

18. Intellectual Property

Customers agree that notices, invoices, quotations, order confirmations and other communications may be provided electronically by email or through our website.

Electronic communications are deemed received when transmitted unless proven otherwise.
